1. Scope of Application
The following terms and conditions apply to all orders placed through our online shop by consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of their commercial or independent professional activity when concluding a legal transaction. Regarding entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their applicability is hereby rejected; they will only become part of the contract if we have expressly agreed to them.
2. Contract Partner, Conclusion of Contract, Correction Options
The purchase contract is concluded with 3Drifter. By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained during the ordering process. The contract is concluded when you accept the offer by clicking the order button for the goods contained in the shopping cart. Immediately after submitting the order, you will receive a confirmation via email.
3. Language of the Contract, Storage of Contract Text
The language(s) available for concluding the contract: German. We store the contract text and send you the order details and our terms and conditions in text form. You can view the contract text in our customer login.
4. Delivery Conditions
In addition to the stated product prices, shipping costs may apply. Further details regarding any shipping costs can be found in the offers. We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.
5. Payment
The following payment methods are generally available in our shop:
Credit Card
During the ordering process, you will provide your credit card details. Your card will be charged immediately after placing the order.
SEPA Direct Debit
By placing the order, you grant us a SEPA direct debit mandate. We will inform you at least one banking business day in advance about the date of the account charge (so-called prenotification). A banking business day is any weekday except Saturdays, nationwide public holidays, and December 24 and 31 of each year. The account charge occurs before the goods are shipped.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. Further information will be provided during the ordering process. PayPal may offer additional payment options to registered and selected PayPal customers based on its own criteria. We have no influence on the offering of these options; any individually offered payment options concern your legal relationship with PayPal. Further information can be found in your PayPal account.
Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have the Google Pay function activated, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information will be provided during the ordering process.
Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have the Apple Pay function activated, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information will be provided during the ordering process.
Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available for consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information will be provided for each payment option and during the ordering process.
Klarna Direct Debit
You grant Klarna a SEPA direct debit mandate. Klarna will inform you about the date of the account charge (so-called prenotification). The account charge occurs after the goods are shipped.
6. Right of Withdrawal
Consumers have the statutory right of withdrawal as described in the withdrawal information. Entrepreneurs are not granted a voluntary right of withdrawal.
7. Transport Damage
For consumers: If goods are delivered with obvious transport damage, please report such defects immediately to the carrier and contact us without delay. Failure to make a complaint or contact us will not affect your statutory rights and their enforcement, particularly your warranty rights. However, you help us assert our own claims against the carrier or transport insurance.
8. Warranty and Guarantees
8.1 Warranty Rights
Unless expressly agreed otherwise below, the statutory warranty rights apply. The following restrictions and time limitations do not apply to claims for damages caused by us, our legal representatives, or agents.
- In case of injury to life, body, or health
- In case of intentional or grossly negligent breach of duty as well as deceit
- In case of violation of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contractual partner may regularly rely (cardinal obligations)
- Within the scope of a guarantee promise, if agreed, or
- As far as the scope of the Product Liability Act is opened.
Restrictions for Entrepreneurs
For entrepreneurs, only our own specifications and the product descriptions of the manufacturer included in the contract apply as an agreement on the quality of the goods; we assume no liability for public statements of the manufacturer or other advertising claims. For entrepreneurs, the limitation period for warranty claims for newly manufactured goods is one year from the transfer of risk. The statutory limitation periods for the recourse claim under § 445a BGB remain unaffected.
Regulations for Merchants
Among merchants, the inspection and complaint obligations regulated in § 377 HGB apply. If you fail to report as required there, the goods are deemed approved unless there is a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.
8.2 Guarantees and Customer Service
Information on any additional guarantees that may apply and their exact conditions can be found with each product and on special information pages in the online shop.
9. Liability
For claims due to damages caused by us, our legal representatives, or agents, we are always fully liable
- In case of injury to life, body, or health,
- In case of intentional or grossly negligent breach of duty,
- In case of guarantee promises, if agreed, or
- As far as the scope of the Product Liability Act is opened.
In case of violation of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contractual partner may regularly rely (cardinal obligations) due to slight negligence by us, our legal representatives, or agents, liability is limited to the damage foreseeable at the time of contract conclusion, the occurrence of which is typically to be expected. Otherwise, claims for damages are excluded.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
