General Terms and Conditions

1. Scope of Application

The following General Terms and Conditions apply to all orders placed through our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.

A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the course of its trade, business or independent professional activity.

The following applies to businesses: If a business uses conflicting or supplementary general terms and conditions, we hereby object to their application. Such terms and conditions shall only become part of the contract if we have expressly agreed to them.

2. Contracting Party, Conclusion of the Contract, Correction Options

The purchase contract is concluded with 3Drifter.

By displaying products in our online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.

The contract is concluded when you accept the offer for the goods contained in your shopping cart by clicking the order button. Immediately after submitting your order, you will receive an order confirmation by email.

3. Contract Language, Storage of Contract Text

The language available for concluding the contract is German. Our online shop is also available in several other languages. These translations are provided to make our offers and information easier to understand.

We store the contract text and send you the order details and our General Terms and Conditions in text form.

Our General Terms and Conditions are also available on our website at any time.

4. Delivery Conditions

Shipping costs may apply in addition to the stated product prices. Further information about any applicable shipping costs can be found in the respective product offers or during the checkout process.

We deliver exclusively by shipping. Collection of goods in person is not possible.

5. Payment

The following payment methods are generally available in our shop:

Bank Transfer (Advance Payment)

If you choose to pay by bank transfer, we will provide you with our bank details after you have placed your order.

Please transfer the full invoice amount to the specified bank account, quoting your order number as the payment reference.

Processing of your order will begin once we have received the payment in full. The goods will be dispatched once the ordered items have been produced.

Credit Card

You enter your credit card details during the checkout process. Your card will be charged immediately after placing your order.

SEPA Direct Debit

By placing your order, you grant us a SEPA direct debit mandate. We will inform you of the date on which your account will be debited at least one banking business day in advance (known as pre-notification).

A banking business day is any working day except Saturdays, nationwide public holidays in Germany, and 24 and 31 December of each year.

Your account will be debited before the goods are dispatched.

PayPal

To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself using your login details and confirm the payment instruction.

The payment transaction is carried out by PayPal immediately after placing your order. Further information is provided during the checkout process.

PayPal may offer additional payment options in the customer account to registered PayPal customers selected according to its own criteria. We have no influence over the availability of these options. Any additional individually offered payment methods are subject to your contractual relationship with PayPal. Further information can be found in your PayPal account.

Google Pay

To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated Google Pay, authenticate yourself using your login details and confirm the payment instruction.

The payment transaction is carried out immediately after placing your order. Further information is provided during the checkout process.

Apple Pay

To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have activated Apple Pay, authenticate yourself using your login details and confirm the payment instruction.

The payment transaction is carried out immediately after placing your order. Further information is provided during the checkout process.

Klarna

In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options.

Payment via Klarna is only available to consumers. Unless otherwise specified below, payment via Klarna requires a successful address and creditworthiness check and is made directly to Klarna.

Klarna Direct Debit

You grant Klarna a SEPA direct debit mandate. Klarna will inform you of the date on which your account will be debited (known as pre-notification). Your account will be debited after the goods have been dispatched.

6. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in our withdrawal policy.

Businesses are not granted any voluntary right of withdrawal.

7. Transport Damage

The following applies to consumers:

If goods are delivered with obvious transport damage, please report such damage to the delivery company as soon as possible and contact us without delay.

Failure to report the damage or contact us will have no consequences for your statutory rights or their enforcement, particularly your statutory warranty rights.

However, doing so helps us assert our own claims against the carrier or transport insurance provider.

8. Statutory Warranty Rights and Guarantees

8.1 Liability for Defects

Unless expressly agreed otherwise below, the statutory provisions regarding liability for defects shall apply.

The following limitations and shortened limitation periods do not apply to claims arising from damage caused by us, our legal representatives or persons employed by us to fulfil our contractual obligations:

• In the event of injury to life, body or health;

• In the event of intentional or grossly negligent breach of duty or fraudulent conduct;

• In the event of a breach of essential contractual obligations, the fulfilment of which is necessary for the proper performance of the contract and on which the contractual partner may regularly rely (cardinal obligations);

• Within the scope of a guarantee commitment, where agreed; or

• Where the German Product Liability Act (Produkthaftungsgesetz) applies.

Limitations Applicable to Businesses

In dealings with businesses, only our own statements and the manufacturer's product descriptions that have been incorporated into the contract shall constitute an agreement regarding the quality and characteristics of the goods. We accept no liability for public statements made by the manufacturer or other advertising claims.

For businesses, the limitation period for claims relating to defects in newly manufactured goods is one year from the transfer of risk.

The statutory limitation periods for rights of recourse under Section 445a of the German Civil Code (BGB) remain unaffected.

Provisions Applicable to Merchants

The obligation to inspect goods and notify defects pursuant to Section 377 of the German Commercial Code (HGB) applies to merchants.

If you fail to provide the notification required under this provision, the goods shall be deemed accepted unless the defect could not have been detected during inspection.

This does not apply if we have fraudulently concealed a defect.

8.2 Guarantees and Customer Service

Information about any additional guarantees that may apply and their exact conditions can be found with the respective products and on dedicated information pages in our online shop.

9. Liability

We shall always be liable without limitation for claims arising from damage caused by us, our legal representatives or persons employed by us to fulfil our contractual obligations:

• In the event of injury to life, body or health;

• In the event of intentional or grossly negligent breach of duty;

• In the event of guarantee commitments, where agreed; or

• Where the German Product Liability Act (Produkthaftungsgesetz) applies.

In the event of a breach of essential contractual obligations, the fulfilment of which is necessary for the proper performance of the contract and on which the contractual partner may regularly rely (cardinal obligations), caused by slight negligence on our part, by our legal representatives or by persons employed by us to fulfil our contractual obligations, liability shall be limited to the amount of damage foreseeable at the time the contract was concluded and typically expected to occur.

All other claims for damages are excluded.

10. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Extended Producer Responsibility (EPR)

France

Under the French Extended Producer Responsibility scheme (Responsabilité Élargie du Producteur – REP), we have been assigned the following Unique Identification Numbers (Identifiants uniques – IDU) for the respective product and waste streams:
